Clearance

After Import Declaration (DI) register the process for customs clearance starts and DI is subjected to audit analysis and selected for one of the review channels. This selection procedure is known as parameterization.

The system for import clearance, made randomly by SISCOMEX, can occur in the following parameterization modules:

GREEN CHANNEL: System automatically clear merchandises although customs agency can select it for further checking either by merchandise type or by history of people involved in clearance (importer/customs agent) or other parameters defined by customs agency.

YELLOW CHANNEL: For these cases it is needed to submit clearance for document checking and this does not free it from being checked physically or have the merchandise’s value checked; this is the reason that clearance must be carefully written and detailed.

RED CHANNEL: In these cases, clearance will have its documents checked and merchandise physically checked. For this the customs agent must write a perfect clearance and be familiar and have a deep practical knowledge of issues that involves the clearing of goods regarding the legal system and audit agents.

GRAY CHANNEL: It is the longest process as it passes through the steps above mentioned and will have a special customs control procedure for checking elements that indicates fraud and regarding declared merchandise price.

The customs clearance is the act where customs check conclusion is registered; it is with the customs clearance that the merchandise delivery to importer is authorized.

It’s worth highlighting that clearances will be subject to customs review as well as merchandise can be subject to checking either in way or at the importer’s property independently of the parameterization channel that it was cleared.

Warning:
It is important to emphasize that for a five-year period, beyond the import/export execution period, there must be a perfect filing system of all documents related to the operation; and the lack of compliance with this obligation may implicate severe penalties to all parties involved in the operation, such as importers/exporters, customs agents and other intervening parties.
